too bad this discussion is still on!
its all about which side of the fence you are on!

i dont think anyone is cutting the line...there were already there..well before you ..they just rejoined with the right set of documents..

if you are willing to stick around for 10 years in the same job.. doing the same thing...hoping for ur GC to come thru...so that u can switch..then good luck to you..

i am sure WHEN USCIS formulated the law..they would have had this discussion...of how to accomodate "high skilled" workers..who climb the ladder ..and who aquire better qualification...and who have the b***s to change jobs and not be slaves to GC process.. this law is them..

Go ahead and file the case rolling stone...i will be the first to oppose it...c u in the battelground..;-)

    in this context...i am a Pandu..u are a gandu..(pun intended)

    I agree with "singhsa".
I was reading through this thread and couldn't help replying.

Before i voice my opinion, i would like to mention that I have a Ph.D in Aerospace Engineering (2002-2006 from a very reputed univ. in the US). My husband's employer (non-IT) had applied for his GC in EB3 - in 2005 which makes sense since the job required a B.S (Even though he was MS and was working for this company since 2002). We have our 485s filed and are using our APs/EADs. Now, i haven't applied for GC through my employer yet, but if i apply, it would most likely be EB1 or 2, and would love to port my PD of 2005. The reason i haven't done that is because i personally do not think that getting a GC couple of years earlier is going to make my life any different than it currently is.

Having said that, I completely understand what "rolling flood" is trying to say. And I also agree to what his point of view is. When a person who initially agreed to apply with EB3, changes his mind/company/ or whatever and wants to apply in EB2, he should theoretically start over. Why is it reasonable that he/she cuts in line ahead of a person who was already there. There is a reason why these categories are formed.

Shady means or non-shady means, EB2 means that u have superior qualifications and you are more desirable in the US.
EB3 means there are a lot like u, so u gotta wait more. Period.

    [QUOTE=sab;309415] Terrible. From NPR

"Eventually, Red Cross and Palestine Red Crescent rescuers received permission to go into the shelled houses. Pierre Wettach, head of the ICRC for the region, called it a "shocking incident." "The ICRC/PRCS team found four small children next to their dead mothers in one of the houses. They were too weak to stand up on their own." [Quote]

That is really sad, it is similar to the two year old son of the Jewish Rabbi and his Wife who was sitting with blood of his dead parents on him when his caretaker took him and ran away during the Mumbai carnage, what I read later was that they were sexually humiliated and killed. When small kids are taught to blow themselves up, that is sad too. There are many orphans of war and hatred and violence. I wish this madness stops from all sides or at least let them take this war to the battlefield, not in places where people live.

Everyone say "H1b is not good we want more GC". Then the whole thing moves towards a new points based system and everyone will support it saying - this will ensure US will have best and brightest. What happens to us???? We will be ignored

I think for those waiting long enough would get extra points....5 Points/year of waiting :D:D:D:D:D

    Guys,

Looks like we may see some action from India within hours now. The war clouds have been gathering ever since the Mumbai attacks. But now the signs of an imminent war are unmistakable.

Apparently India had given pak a deadline of one month to hand over the perpetrators of this attack. The deadline expires on December 26th.

Both India and pak have canceled the leaves of their military personnel.

People in border villages of Rajasthan are evacuating.

CNN has been reporting that paki troops are on the move.

If my hunch in right, something big will happen in next 24 hours.

    You there, Beemar? ;)

India is not going to attack in your and my life. India has never invaded any country in it's history, (i don't know if it's peace loving or lack of balls), but several invaded, defeated, ruled and looted India. Just being big (1 billion) does not mean anything, you need the guts to avenge/attack, look at Israel, Vietnam if you need examples. Why can few tigers attack the hurd of dozens of dears/buffalos/cows and make them run ?

India could not even fix LTTE, forget Pak.

Some common thinking patterns that immerge out of these conversations. Please understands that these are all "amoral" paradigms, nothing else, you can pick and choose any of these set of values and lead your life on it, the choice is upto you. Nobody is right and nobody is wrong, except in their own imagination.

    1. Money cant buy happiness
    2. Bigger home doesnt mean better life for kids.
    3. Life in US is better than life in India
    4. Life in India is better than life in US.
    5. Our parents had more time for us than we do for our children
    6. It is better to be content and happy than to be materialistic and unhappy.
    7. Stability is more important than commiting a big chunk of your money.
    8. Good neighborhoods is whats more important.
    9. Renting is good for immigrants till they get their green cards.
10.Buying house in this market is stupid.
    11. Buying house in this market is smart.
    12. I already bought the house and loving it
    13. Wait till they kick you out of the country, then tell me that you love your house. you know they sometimes make some stupid mistakes with your application and there is no telling whether you could be their victim even if you have cleanest case for GC.

i can go on, but come on guys, dont you get it? Who wins with these arguments. NOBODY. Do what you think is right for you and your family. as simple as that...

    Cheers!

CIR is coming BACK in 2009! The only change that will happen in immigration is CIR due to the pandering politics. IV and all its members focus should be ensuring CIR is not passed on the backs of EB green cards. The group most likely to be screwed over will be EB3. All our energies and money should be on CIR and that we have a seat on the table when these compromises are made.

We always hear "the rules" from the female side. Now here are the rules from the male side. These are our rules! Print this out and pass to your partner for a greater understanding:

    1. Learn to work the toilet seat. You're a big girl. If it's up, put it down. We need it up, you need it down. You don't hear us bitching about you leaving it down.

    2. Birthdays, Valentines, and Anniversaries are not quests to see if we can find the perfect present yet again!

    3. Sometimes we are not thinking about you. Live with it.

    4. Don't cut your hair. Ever. Long hair is always more attractive than short hair. One of the big reasons guys fear getting married is that married women always cut their hair, and by then you're stuck with her.

    5. Crying is blackmail.

    6. Ask for what you want. Let us be clear on this one: Subtle hints do not work! Strong hints do not work! Obvious hints do not work! Just say it!

    7. We don't remember dates. Mark birthdays and anniversaries on a calendar. Remind us frequently beforehand.

    8. Most guys own three pairs of shoes - tops. What makes you think we'd be any good at choosing which pair, out of thirty, would look good with your dress?

    9. Yes and No are perfectly acceptable answers to almost every question.

    10. Come to us with a problem only if you want help solving it. That's what we do. Sympathy is what your girlfriends are for.

    11. A headache that lasts for 17 months is a problem.See a doctor.

    12. Check your oil! Please.

    13. Anything we said 6 months ago is inadmissible in an argument. In fact, all comments become null and void after 7 days.

    14. If you think you're fat, you probably are. Don't ask us. We refuse to answer.

    15. If something we said can be interpreted two ways, and one of the ways makes you sad or angry, we meant the other one.

    16. You can either ask us to do something or tell us how you want it done. Not both. If you already know best how to do it, just do it yourself.

    17. Whenever possible, please say whatever you have to say during commercials.

    18. Christopher Columbus did not need directions, and neither do we.

    19. All men see in only 16 colors, like windows default settings. Peach, for example, is a fruit, not a colour. We have no idea what mauve is.

    20. If it itches, it will be scratched. We do that.

    21. We are not mind readers and we never will be. Our lack of mind-reading ability is not proof of how little we care about you.

    22. If we ask what is wrong and you say "nothing," we will act like nothing's wrong. We know you are lying, but it is just not worth the hassle.

    23. If you ask a question you don't want an answer to, expect an answer you don't want to hear.

    24. When we have to go somewhere, absolutely anything you wear is fine. Really.

    25. Don't ask us what we're thinking about unless you are prepared to discuss such topics as the shotgun formation, or monster trucks.

    26. You have enough clothes.

    27. You have too many shoes.

    28. No you really do have too many clothes and shoes.

    29. BEER is as exciting for us as handbags are for you.

    30. Thank you for reading this; Yes, I know, I have to sleep on the couch tonight, but did you know we really don't mind that, it's like camping.

    31. I'm in shape. ROUND is a shape.

I wish Obama wins. His team has more clarity on many issues and he has the zeal like JFK for making things happen. But, a big but - I am very concerned about our Employment Based immigration. If he gets to win (I wish he does..as someone who want to see America regain it's global position not just with might but also being morally right), I am worried if it would be Sen. Durbin who will dictate the immigration policy.

I wish we get some clarity in this aspect. In the economic downturn, I wish to work more than I ever did and see that US comes out of recession fast. But for that I have to be inside the country first. I have to be given a fair chance to contribute to this economy first and I need to be treated with respect and honor.

Its a pity when it is obvious through numerous congressional debates who the culprits are in blocking EB friendly legislation. Here we are again with the EB recapture bill and who again is blocking it? The New York times identifies them by name and nowhere does it mention Durbin. Its thus is beyond comprehension when unfounded future claims of doom, apprehension and fear are spread without the basis and contrary to facts presently before us. Instead one needs to be more concerned about the possible reelection of the two below and several of their sidekicks:

    Jeff Sessions (R)
    Steve King (R)

A House bill that could recapture an estimated 550,000 lost visas, sponsored by Representative Zoe Lofgren, a California Democrat, has been moving slowly through the committee process despite the best efforts of members like Representative Steve King, Republican of Iowa, to sabotage it with ridiculously restrictive amendments.

In the Senate, Robert Menendez, Democrat of New Jersey, is insisting that a visa-recapturing amendment be added to a bill reauthorizing E-Verify, the federal database program to prevent the hiring of illegal immigrants. For this, he has endured an onslaught of criticism from nativist groups and colleagues, like Jeff Sessions of Alabama. This is total BS.
Bashing Illegal immigrants for housing market crash and accusing entire race of being theives is nothing new among right wing anti-immigrant "Hatriots"
But there really isn't co-relation between illegal migration and housing crash.. if anything, migrants are also first time buyers and they support prices towards to lower end market and stop entire lower-middle class neighbourhoods from becoming what Detroit or Youngstown have become..
So no need to parrot hateful propoganda here.. lets stick to the point..
o.k. ..I had copied comments from other readers and I have removed the unnecessary remarks ..The only reason I am keeping the remaining portion is to show how many of the first time buyers (I guess Americans) feel. so if lot of people think like the above then housing will take longer to stabilize. (BTW I agree there is no relation between immi and housing crash - nor is it implied in the comments I had pasted). I guess sometimes it makes sense to read what other readers / natives feel about certain situations. a final thought (unless I have to respond to someone else's post) - everywhere I look (articles and in real life) - things are real bad in terms of real estate. will things improve - definitely but it may take long time for things to stabilize and hence it makes sense to do extra research before taking a plunge. for e.g at present I am staying in a rented town home - and I got the deal for $850 - the town homes are inside an apt complex in a good neighborhood. (you need to show income of atleast 3 times the rent to get a place here and many tenants are high tech guys). the same town home during boom time had rent of $1250 ..in other words - there are tons of deals due to excessive supply everywhere. one other important point was made by another person - this winter was harsh and hence people did everything to keep a roof above their head - wait till summer and you will see people literally walking away from their homes ...when u read posts like the above ..it makes sense to wait for some more time esp on H1 / EAD.

I bought one in the first year of my H1. I changed it last year. I am in the 9th year now. It is the *only* sensible investment I made.

You actually nailed down exactly what i have been thinking...

Its just seems impossible to get a decent house which is not 25+ in Cupertino, Redwood shores etc ..And my gut feeling is these places the homes will never be affordable, they may lose some value but not much.

I have also been debating about Austin as an alternative. Again what field you work in also plays a big role in the decision. if you are a techie and work in a product based company Bay area has all the top companies you could wish to work for. Where as cities like Austin merely have satellite offices for these companies based in bay area. I guess if you work in the service industry you would have more choices to pick from. Plus reason to consider austin for me is that "Austin is very much like bay area" ... In that case i think why not live in Bay area itself :)

But yes if you are in bay area, Paying 700+ for a decent place just does not make sense even with all the rebates.

I am hoping my gut feeling is proven wrong :)

I moved out of bay area last year to WA. I had mixed feelings about making the move, but except for the weather, I think it was a good decision. One year down the line, I feel happy about it. The home you get for 700K in bay area, you can get for 550K in Seattle. Not much different, but somewhat cheaper.

    I am

After the bail-out bill failed in the House, Obama immediately posted a response reassuring Americans and investors that the leaders will come up with another soon.

Contrast this with McCains partisan blaming of Obama for failure of bailout, while it was him that pulled the stunt of rushing to Washington to 'rescue' the bailout. After failing to show the leadership of his own party -with majority of Repubs voting against the bailout (a clear indication of leadership failure and ineffectiveness of McCain Presidency in passing anything through his own party!), he found it convenient to Obama.

And it was Obama who proposed raising FDIC insurance to $250,000 to which McCain has (thankfully) chimed in.

Going thru Obama's comments, he is sure to put a stop on H1B visas in the name of keeping American jobs in America. Then what would happen is that all American companies will send their whole IT departments to India. The end result will be that there would not be any decent paying jobs in this country.

CIR will pass and illegals will choke the whole USCIS. Good bye to EB GCs.

Just Kidding - reading your post i was feeling like I'm reading a comment from Fox News. However i do respect your opinion and thanks for expressing it.

My Point is more long term - in the shorter term no major change can happen to economy even if Barack wins but eventually Economy would be stronger under Barack's leadership. He also stressed that he would stop "JOBS BEING SHIPPED OVERSEAS" which means companies like TATA or INFY or some Chinese company taking my Job ( or any American's Job ) away from US to INDIA or CHINA. If you are planning a future in US - you would not want your US job taken away by your brother at INDIA or CHINA and Barack will make sure that doesn't happen.

The Bottonline is he will create tons of Jobs at US , so unemployment will be very low , average peoples will be happy and however loud ANTI-IMMIGRANTS scream and shout no AMERICAN will pay attention. Our EB reforms will Pass much easily and we will be able to able to lead a much happier and content life with GREEN CARD.

Once again my Point is definitely Long Term - in the shorter duration Barack has to first fix the Mortgage Mess and do something with Iran by taking help from EUROPE.

Even if terrorism is accepted because someone in their family killed terrorists have to target those people who had killed their family members In what way a child from Bombay was reason for sufferings of Afghanistan or Kashmir? In my view Terrorism was spread by some leaders for their enrichment. You can see lifestyle of LET and other Terrorist group Leaders in Pakistan. They were living in big Mansions with bullet proof cars with multiple Wives at the same time the trained terrorists are killing the innocents at the same dying themselves.

be it Palestine, Iraq, Afghanistan Somalia,Darfur,Chechnya, Kashmir, Gujarat... everywhere muslims are killed for being muslims...noone goes to cuba, srilanka, north korea, zimbawe or whereever for watever reason...just imagine God forbid someone comes into your house, occupies it, kills your family, your brothers and sisters in front of you and kicks you out of your home and you are seeing no hope of justice... you wont stand outside your home sending flowers like munna bhai's gandhigiri.. trust me you will become a terrorist.

    So Mr. Trained Reservist,
Let's say the war is won in 15-20 days based on your expert knowledge, what is next? India occupies Pakistan? and acquires 160 million muslim population along with Talibans? You think that will end terrorism and riots in India?

Oh BTW, there is another trained reservist in the history who claimed Iraq war would be won in two weeks. Do you know who he is? Hint: he became the worst president in the history of the US.

The war was won in two weeks. Americans have traditionally poured billions of dollars in rebuilding nations that they have destroyed. What was unexpected was the insurgencies and the sectarian violence, which Iraqis themselves are guilty of. The war went horribly wrong because of the atrocious cost of the war and the drain on the failing economy. Saddam was an evil dictator and the fact that there is so much insurgency is a clear indication that Iraq was the hotbed of terror.
That is why its taking longer than expected.

If you want to debate on Hiroshima and Nagasaki, read the kind of savages the Japanese were. Read about comfort women. http://en.wikipedia.org/wiki/Comfort_women. It will make you really uncomfortable. Worse, till date the Japs are unapologetic saying there is no credible proof that this ever existed. Also, read about Bangladesh war http://en.wikipedia.org/wiki/Bangladesh_Liberation_War where 200k women were repeatedly raped giving birth to thousands of war babies, who were exported to orphanages in Europe and America.

I have full sympathy for anyone that has not broken any laws including OP and 'leoindiano". If I had the powers to approve green cards, I would give them away to him and his brother!

The problem here is no one (consulting company/employee) bothered to make sure that a person on H-1B was allowed to do consulting. I'm not sure who dropped the ball - companies, employees, or the immigration lawyers. But someone should have raised a flag when the type of job was really a temp job. Unfortunately that did not happen.

Now that the damage has been done, and USCIS is coming after such folks, they are upset that it is happening to them. Again, do note that I am not saying the consultants themselves are less skilled than anyone with FT job. I'm just saying that at the time they got into consulting they did not think of the various consequences. Maybe because no one ever thought that working at different locations, benching, temp nature of the jobs were all against H-1B visa rules?

    You get my point?

face it as long as the economy is tanking this is going to be an ongoing debate. Everything goes thorugh stages of high and low and we are now expereincing the lows of having the h1b's.

Sledge While your points are valid, remember folks do not choose consulting (nor do students) as a first choice but I have friends who were employed without any issues directly with client companies who in the midst of recession decide to fire everyone. What are you options if your GC is denied because the company declared bankruptcy? How do you justify to yourself staying with the employer when they files you under Eb3 category when you a master's degree holder from one of the 10 best universities in the US? What are the employee choices here, just pack up and leave? leave houses, friends and people you stayed with many years.

You think they haven't searched for full time positions with other companies only to be turned back? or worse case restart the entire GC process and forgo the 6+ years?

And the experiences I am relating are from the 2001 recession. I have already seen history repeat itself now but my more fear is that tomorrow USCIS will unfortunately hit the person who followed all the rules After all how is the USCIS knowing which are the good companies and which are bad? These very things are happening and very much can happen to you as well. Do not sit on a high perch and think it will not trickle down to me
