If I understand correctly, there is no mechanism for unused EB visas to spill over to the following year's EB, but the law allows unused FB visas to spill over to the following year's EB ?!
The unused Employment Based visas will be added to the following year's Family Based visas.

I think here everybody are agreeing to the same thing. Some valid points,
1) People are agreeing pre-LTTE situation was no rosy.
2) Sinhala-Tamil conflict has some deeper socio-ecomomic reasons
3) Sinhala people were less tolerant. Like usually adaptable minorities, SL Tamils did not learn Sinhalese when "Sinhala-Only" policy came. (while everybody learnt English (and many Chinese) in Singapore.
4) Indian politicians (whatever reasons they might have) in 1980s supported LTTE - camps run by RAW and Indian Army trained LTTE. So, we created a monster. Just like American forces trained OBL in Afghanistan as part of Mujahideen against Russians. So, we reaped what we sowed.
5) Some spineless leaders from TN support LTTE. More than anybody they dont know the difference. Or may be to harvest some votes by flaring up emotions.
6) LTTE is evil and has no place on earth.
7) As soon as conflict is over, we have to make sure that SL will really understand how to solve the crisis. SL has to become secular, adapt common business language (English??) and coexist with the north. Short term, they should perhaps grant limited autonomy. It was done earlier and it worked almost everytime, Just need some leadership. Again, this should be our hope and suggestion. No self-respecting country can be told what to do. We can suggest in exchange for some favors. Or else we will be marginalized.
And for good, we should not meddle into others affairs. Whether we hate or love Congress, we all know Rajiv Gandhi would have made lot of difference than many weak PMs we saw after PVN. We lost him in hands of an evil orgn. So, pray that they are eliminated with ZERO innocent people being killed.

My take is BODY SHOPPING is killed.
H1Bs can work at direct employer or as an employee of direct vendor at off site.
No more small consulting firms sending resumes to direct vendors. May be in long term its good for H1Bs.
Mostly Desi consulting firms will get hit. Outsourcing companies like TCS,Infosys are direct vendors to big clients. They will OK ..
My take is Infy, TCS are the biggest theives. if you work with the client, you never know when the will show the door and promptly cancel the H1B. Ideally USCIS should target the big fish and their flithy L1

Dear Attorney,
I was hoping you could help or answer this question.
My GC was approved last month after a very long wait time. Currently I am working for company B on EAD (not the GC filing employer). The question I had was can I continue to work for company B on a part time basis and join company A (GC filling employer).
Company A has a 9 month probation period I am worried if i quiet company B and company A fire me later then I will be with out job.
So I can work for company A (GC filing employer) full time and at the same time work part time with company B.
So this way if company A does fire me during probation period I continue with company B on full time basis.
Is this ok will it come to haunt me when I file for citizenship?

As for "formerly superior Tamil competitiveness", I am sure what you refer to is, the fact that during the British period, the Tamils were given the lion's share (pardon my pun) of all the civil service and other administrative jobs as part of their divide and Rule policy. When SL gained independence of course, things changed so that formerly discriminated Sinhalese started getting their fair share of thse opportunities. Mind you that Sinhalese are after all 75% of SL. Are you saying it is fair to ask 12% of the population (SL Tamils) to have 50% of all the opportuniies and land and the resources reserved for them???

I don't know much about Australia but I can give a sample situation. One could get Australian PR, live there for two years, get citizenship, apply for a job in the US and enter on an E3 visa which is renewable every two years and allows one's spouse to work.

In addition we as legal immigrants are taxed without any representation. Taxation without representation was the reason the US was created in the first place.
US history is full of examples where discrimination existed in one form or another and these discriminations were sucessfully challenged. A few examples are women's voting rights, minority voting rights and gerrymandering. These are good examples to study where the affected people had no legal voice to begin with.
The civil rights movement is a recent example. There were existing laws that limited people from voting based on their literacy levels in the southern states. The literacy requirement for voting was really a thinly veiled attempt to limit voting rights of african americans for as long as possible. The civil rights movement was about changing these artificial laws to give voting rights to people who legally had no voice.

You don't need to be a lawyer to speak up for your hardships as a law abiding resident. This country has tremendous protections for people living here which is what makes it great. We as an immigrant community need to build our awareness of US history and government if we expect things to change.

For two years in a row, H1 quota wasn't used precisely because of that. & if H1 is the first step, theres an even stronger argument for doing away with EB quotas- but given the current environment obviously fearmongers rule (so we're the one 'acquiescing' Lou). I think we should make the case but as Mark pointed out its costly and not the best strategy for us.

Sri Lankan Tamils may not be Indian citizens but are etinic Indians and that is what their problem is and it is the problem in several other places like Malasiya, Fiji, Trinidad etc. these people are still called Indians in these countries and being discriminated. India being a powerful nation should protect the rights of ethnic Indians, but it doesn't....most or all of us know the reasons, it is being ruled by a lame duck govt. who cannot protect citizens living within the Indian boundries, so even if they try to interfere in other countries affairs, I'm sure even a smal coutry like Sri Lanka has guts to say Shoooo!!!! to our foreign Minister. No one cares who the heck is he...when dozens of people dying without food and because drought, GOI has better jobs to do rather than going after the BCP for this moron. How many times Ambika Soni cared about normal people are suffered in security check. We are still struck colonial mentality and hero worship. This crap is happening only in india. They are expecting the same from US as well.
It happens everywhere. Politicans bank on these stars - stars get along well with businessmen, politicians fight and then kiss each other. Stars marry, divorce, remarry - and the list goes on.
Come on, it happens everywhere, not only in India. How many times do you not see 80 year old rich businessman marrying 26 year old beautiful model?
Look at how the bailout money has gone to those people who screwwed the economy.
The reason you think India has issues that other countries do not have is because you are still not stepping out of your Indian shoes.
Go out with your American friends for a drink and discuss these issues - for every issue you discuss - you will get a parallel American counter issue that is similar in nature.
There is nothing called "absolute" in this world and you will realise it now or later. Live in a country side with a constant income and you will find life peaceful because you are not bothered by what is happening.
Or try helping people - and do social service - you will realise that it is a dangerous and thankless job.
Democracy is "not exactly" how it sounds. Unfortunately, life is not fair to anyone and one has to live in within his/her means.
Crying foul over all such stuff will not bring changes. Working within parameters to bring about changes is "unfortunately" the only way how changes have come to the "Mother Earth"

Diseases are spreading, sanitation is bad, farmers are facing drought - so many things happening. Lets not blame SOME PEOPLE for all this. it is us collectovely who can bring about change.
