    There may or may not be constitution grounds to challenge the law, I've thought about this too, however from a pragmatic point of view....

    1) The money needed to pay the lawyers would likely be more than for lobbying. Importantly money for legal costs is best to be on hand -- i.e. good cash flow, otherwise you risk missing legal deadlines. It would mean diverting money from lobbying. If we were flush with cash e.g. every member paid just $100 per year this would work.

    2) Even among members of congress that are behind us, several have reservations about removing country cap (although they are willing to raise it).

    3) EB3 ROW is retrogressed anyway. India EB3 is about May 2001, and ROW EB3 Oct 2002. The effect of only removing country quota would be put EB3 generally at about Oct 2001.

    The way to move forward for all is to increase total through put, e.g. raise caps, remove dependents from caps, recapture unused quota, tie caps to multiple of H1B quota. For ROW it would move steadily forward, and India move and then would jump forward every 4th quarter with massive spill over from ROW.

    As I said I'm not against the idea in principle, just being pragmatic.

    This can all happen if we take the stand.

    Otherwise, we can all see our hairs gryaing with PDs in 2001 and 2002.

    Do you guys remember how many visas USCIS processed within the Last few days of June 2007 ( I remember it was around 20k) just to make sure they exhaust the Visa numbers and rollback the Visa Bulletin?

    If it's possible for them to complete as many applications within a short span of time,it means they are capable of processing the applications faster...

    Now due to more hiring they might process all the available visas by the end of the year.

    Not that I'm having hopes of me getting 485 approved based on my PD, but just to put things in perspective....

    We'll see once we hit Aug 1st......

    You know what I used to think like this too.

    President of India is put up in hotel and Saino&family in palace during Bhutan king coronation and they said Saino is personal guest of the royal family so may be that's ok.

    Media on one hand calls this person homemaker (Priyanka Gandhi)and on the other hand reports that she is in Bangladesh having talks/dinner with Bangladesh PM with Bangladesh State providing security to her which looks like a official visit.Media doesn't mention in what nature is this offcial apart from NREG stuff which looks very fishy.

    Just after UPA came to power Sonia goes to Russia in Reliance plane to meet with Putin.
    I tried to find out why Sonia is in Russia but almost all the papers were excited about the reliance plane(could it be Anil's or Mukhesh's) but didn't say anything about Russia visit.I moved on and still don't what was it about though hoping it was something good for country and not revival of KGB connection(When U.S.S.R collapsed it was made public from KGB archive that Rajiv/Sonia were constant recipients of KGB money.?,it's anybody's guess ).

    Then Sona/Rahul went to china and media was saying Sonia is trying to tell China that their family is back in power making it seem like monarchy within democracy.

    When our company pays for cleaning agency to do the household cleaning for it's employees ,the help that comes to our house will take orders from us rite? Seems the same with some of these media guys.

    What's interesting is people who call themselves cream of the top,(who say) can think clearly are willing to trust the future of their sons and well being of their daughters in the hands of this family.



    Most sickening part was UPA leaders only concentrated on abusing, denying and accusing. They never told the voters if they did any work in last 5 years. I know there wasn't a lot to tell but still the whole campaign is kind of useless...and the role of media is amazing, they just covered 5 people Maino Antonia, Rahul Gandhi, Priyanka Gandhi, Advani & Modi as if nobody else exist in the country. Priyanka Gandhi wakes up every 5 years during elections and media runs after...How sick a country we are ???

    Outsourcing is bad for not only for US citizens but also for future H1bs and GC aspirants also.
    Still all the jobs cannot be outsourced. Also if that would have been the case I would have been out of job. But My salary was increasing steadily and in this tough economy also I was able to get a new job with 20% rise in pay after I lost job . There are many companies in USA who are only hiring USA citizens and discouraging outsourcing. Wherever I was working I discouraged those companies from outsourcing but encouraged them to hire h1bs ,GC holders or US citizens. Many start up companies in California cannot afford to do outsourcing because of tight release schedules.

    Correct. So based on your post, skilled people need not worry about outsourcing. You can argue in favour of onshoring and that is a good argument. I support this kind of approach.

    Technically I can change my country of citizenship any number of times in my life (cannot, if struck like this GC limbo) or even religion but I cannot change my ethnicity even once because I'm born into it.

    I agree Sri Lanka is a sovereign country but why did India poke its nose on the pre-1971 Pakistan and created a new country Bangladesh. Is there a different standard for different people with the Indian govt policies?

    Even If I had not got the opportunity to come this great nation United States of America, land of free and country of brave, I would have done whatever I could in India to help the beleaguered Sri Lankan Tamils and protested against the policies of Govt of India toward this issue.

    I�m upfront about showing my resentment towards my country of birth and I �don�t show false patriotism/nationalism towards India like other Pseudo-Nationalists, who internally betray India at any moment and ready to change their nationality at the next opportunity but externally portray that they are the guardian of India and it is their soul. I currently live in a country, where even burning the national flag is considered a form of protest, if someone thinks that expressing resentment to India or protesting against her policy is unpatriotic, grow up guys.

    The only reason you are carrying a Indian passport is because it suits you for now. The only condition you are willing to ditch that is when you are sure of a better suited passport for you.

Remember the pledge you took during schooling? It said all Indians are my brothers and sisters. If you want to be a world citizen, no issues. People like you are of no use to any country.     hello bobzibub,

    great to see someone welcoming immigrants. My wife is a dentist, licensed in one state of the USA. However she does not have a US DDS. She was licensed by the state as she has great experience and she passed all the tests needed. She has been very well practising dentistry for almost 2.5-3 years now in the US. However, Canada does not let internationally trained dentists get licensed without going to Canadian/American dental school. If you know of any place in CA which would license my wife as she has more than 7 years of exp (4+in India, alomst 3 in USA) and had passed all exams (Board, licensing etc etc), please let me know. That is the single most imp reason for me to still hang im here.

    so you are saying your benefits are not worth $12000? Then whose mistake is it that you parted with it?

    From the day I came to this country , I have spent around $12,000 on immigration including H1-Bs, filing GC, APs, EADs extra. Not to mention the traveling for visa stamps and whole other shit load of expenses. I guess most of people who paid for filing GC did spent same amount of money.

    Hell ya, Some one got to be benefiting from my $12000.

    what I meant was... you can reevaluate your situation from India.
    Since there is nothing there in Canada anyway.

    This is from personal experience. I went through the canadian PR also and now have lost it. I have some friends in Canada and India who had to move because of failure to file for GC before 6yr H1. My view of Canada and other feedback is

    It is not a first world country as they want you to believe.
    The cost of living is very high though the salary is very low.
    Cost of goods is almost the same or most of the time higher than in US.
    Medical is by state (where applicable) but doctors are not good and the wait time is large.
    Taxes are very very high.
    I can go on and onnnn...

    My advice which will save you almost 3k-6k is dont do it if you are waiting for GC. Else you can do it at a short notice. The other options are, if you dont like 5year wait time from India, is to come back in H1 to the US and again reapply. At least this way you know how your GC turned out.

    First i am not a expert nor an analyst musch less a self proclaimed expert analyst. Take that as a given and we can procced further

    None because i do not believe in supporting, representing or furthering the agenda of an organization which has loop holes in it and is determental to my case

    No i have not. Why do i need to visit capitol hill and view in person what congress thinks about EB legislation when i can do the same by watching CSPAN(I am a regular watcher expecially when there is something immigrant related going on. All a process of expanding my knowlesge of immigration or do you think i got up yesterday morning and decided that i want to fight with IV. If you did then i am sorry i gave you more credit then that. And please do not start a new thread about how lazy i am and how i want others to work for me and how i just want the benefit without effort. That would be old and stale. If there is something to be done in which i believe i will be the first to jump in and volunteer

    YES and i never said you are not fair. I know EB2 and EB23 owkr toghether in IV. My efforts of meeting people have been made outside the scope of what you and others do. I am being modest when i say this but i was the first person in my company to make generate awareness about what IV did and how it is helping immigrants like us and encouraged them to visit the website and read about what IV is all about. This is about 75 to 100 indains (EB2 and EB3) in an organization of size 500 during teh time period 2006 to 2007. Now most of them were EB2 so they got their green card and i am sure are no longer on the IV forum anymore. I am sure those who are still on IV forum are EB3 like me. How much they parrticipate, it is hard to tell. Maybe they were smarter than me and got dissalusioned with IV way before i did. They might be porting or they might not be for all i know
    Besides that i am pretty much regular on Murthy where i have provided advise or tried to help people with information whne i could (O f course all of this was H1B/ Visit Visa stuff). Even today on IV forum i am trying my level best to help peopl ewith information related to AOS/EAD/140/485 etc
    I am sorry because what i did till now is nowhere near what you and other IV volunteers are doing but i do what i can when i can.

    Scenario 1:

    Assumptions on Visa Usage by EB1 + EB2 ROW

    1) About the Volume of EB1+ ROW for this year
    (Pending + 2010) Total GC Spill over
    EB1 ALL 4050 + 4050 8100 21995
    EB2 ROW 7871 + 7871 15742 10492 (Total of 32487)

    2) This data is as of August 25 2009, So in the months of September and October approval for India and China assume overall 3000+2000 = 5000

    3) I have not considered EB4+EB5 spill over because that would be a bonus and would result in 2-3 months variation.

    4) Spill over is 50% between China and India
    China would get (16223 spill over + 2387 regular), so china would become current
    India would get (16223 spilover+2387 regular), so India would move to March 06
    5) Let us say 3000 are un-approvable so they will move to June 06
    Scenario 2:
    If the volume of EB1+ROW for this year is 50% of pending then it would result of additional 6000 visas, India would move additional 6 months to December 2006.


    Scenario 3:

    If the volume of EB1+ROW for this year is 25% of pending then it would result of additional 9000 visas, India would move additional 6 months to May 2007.

    I don�t think in any case they won�t move beyond May 2007 for EB2 India as they would not want to add more cases to the Backlog.


    In my gut feel I think Scenario 1 has 60% possibility, 2 has 30% possibility and 3 has 10% possibility/

    Yes, the august bulletin will be showing retrogressed dates. But when August bulletin is issued in mid-July, it does not impact the petitions received in July, because the August bulletin applies to August and even if August is retrogressed until 1975, they still have to accept 485s until 31st July.

    This news has left a lot of our members without sleep I guess. There could be somany people who might be involved in such contract comapanies. At some point we will have to decide between; Can I/we do something about this or how do I prepare myself for such an eventuality.
    I think IV members should work with AILA by offering support and seek their advice on how to understand and face this issue. Some of our members pointed out the AILA is working on this issue so let us contact them first.
    If it seems worthy enough to write to the USCIS directly (properly crafted letter not just self pity) highlighting the importance of sustaining the H1b while ofcourse preventing abuse. Highlighting that H1b is a boon to this economy and taking away jobs from one person does not essentially create job for another. The person was hired by the company/industry in the first place due to a lot of economic reasons that only a true capitalist would understand. Cutting of H1b/labelling H1b as evil and targetting it to destroy the efficacy of this system is actually socialism and this is what needs to be made very clear to the officials.
    They cannot over regulate the "immigration for economic reasons". If they do they are actually destroying the very basis of growth and are "thinking socialist".
